ALSI Mainland Service Shipping Terms and Conditions

Please read these terms carefully, before signing the agreement

The vehicle owner or owner's agent who shall be referred to herein as "Shipper," warrants that he/she is the registered legal owner of the vehicle, or that it has been duly authorized by the legal owner to enter into this agreement.

  1. The vehicle will be transported by one or ALSI's agents and one of its trucking affiliates, who shall be referred to herein as the "Carrier."  Shipper agrees to allow ALSI to act as its agent in dealing with the Carriers and to exercise its efforts on Shippers behalf in placing the order with the Carrier deemed fit.  The Carrier is authorized by Shipper to operate and transport Shippers motor vehicle between its pickup location and the destination set forth on the shipping order bill of lading.

  2. The Shipper designates persons listed at pick up point and/or destination shown on the Shipping Contract as appointed agents for the purpose of delivering to or accepting from ALSI the owner's vehicle(s).  All claims must be noted and signed for at the time of delivery, regardless of the time of day or dirty condition of the vehicle, and submitted to the Carrier with 15 days of delivery.  All damage and service failure claims must be submitted in writing, specifying the damage claimed.  And all claims must be accompanied by two written estimates for repair of said damage, with photographs to support the claim. 

  3. In the event there are any problems regarding transporter delivery, all outstanding freight charges must be paid without deductions from any outstanding charges due.  The shipper warrants that he/she will pay all charges due for delivered vehicles and will not seek to charge back any deposits made via credit card or to stop payment on any checks or other financial instruments tendered to ALSI or the Carrier to offset any disputes for damage claims. 

  4. The Carrier actually transporting the vehicle shall be liable for any and all damage claims arising from the transport of the Shipper's vehicle.  The Shipper agrees, where necessary with the guidance and assistance of ALSI and/or its agents, to file all claims with the Carrier as identified on the bill of lading/delivery receipt, and to bring any legal action for damages against the Carrier only.  The Shipper agrees to hold ALSI harmless from any such claims.  All Carriers hired for truck transport by ALSI's agents have insurance on file with the agent, copies of which are available upon request. 

  5. Any legal action against ALSI must be filed in the Superior Court of California, in and for the County of San Diego.  By executing this agreement, Shipper waves any and all rights to litigate elsewhere.  The prevailing party in any litigation under this agreement shall be entitled to reasonable attorney's fees and court costs incurred.  Additionally, any cost of collection shall be the responsibility of the Shipper.

  6. Pick up and delivery of the Shipper's vehicle is from their door, except where physical limitations and safety concerns make such a pick up (at the driver's discretion) not possible.  Where door pick up or delivery is not possible, the Carrier will arrange for pick up or delivery to be done at a mutually agreeable location as close as possible to the Shipper's door.

  7. ALSI, its agents and their Carriers will make its best effort to arrange to have a vehicle picked u with a scheduled window and delivered with 3 to 14 days of pick up, as is standard in the motor freight industry.  Although we are able to provide an estimated time of pick up and delivery, the Carrier cannot guarantee that such dates will be adhered to.  Shipper understands that the Carrier is subject to delays beyond its control, due to weather, road conditions, supply and demand of trucks and operators, mechanical breakdowns or repairs to tractor/trailer equipment.  Neither the Carrier or ALSI is responsible for car rentals. 

  8. If Shipper is not available at delivery, after reasonable attempts at notification of arrival/availability, the vehicle will be delivered to a terminal at the transport operator's discretion, and there will be extra charges due for storage and delivery of the vehicle.  All C.O.D. and additional charges must be paid before release of vehicles. 

  9. If your vehicle is oversized (over 16 feet in length; equipped with dual wheels; is a pick-up, van or SUV; is lifted or lowered; has oversized or undersized tires, etc., please inquire as to extra charges due.  The standard schedule of additional fees for vehicles oversized or otherwise configured to necessitate special handling/precautions, is $300.  The standard schedule of additional fees for inoperable vehicles is $200.  These additional charges can be greater, if the extra service needed to load, unload or transport a vehicle so warrants.

  10. The Shipper will not load personal effects or household goods into the vehicle.  The trunk shall contain only those items normally found in a vehicle at the time of purchase.  The Carrier is not responsible for any personal effects or other equipment loaded in a vehicle.  The Shipper warrants, upon the tender of the vehicle for carriage that the vehicle contains no personal effects, personal property (except that which is normally found in a vehicle at the time of purchase) or household goods.  The Shipper further warrants that the vehicle does not contain any explosives, guns, ammunition, flammable products, narcotics, negotiable documents or legal papers, alcoholic beverages, jewelry, furs, money, articles of unusual value, live pets or plants, or contraband.

  11. Prior to pick up of the vehicle, ALSI shall have the right to refuse to ship the Shippers vehicle.  In such cases, ALSI shall return to Shipper any payments already tendered by the Shipper to ALSI.  

  12. Should a vehicle shipment ordered by the Shipper be cancelled before being assigned to a Carrier, for any reason, there will be no charges assessed to the Shipper.  If the cancellation occurs after the order has been placed with a Carrier, a $100 administrative charge per vehicle will be assessed.  This fee will be in addition to any other charges incurred by ALSI, its agents or their Carrier relative to the shipment.  All refunds to the Shipper will be processed within three business days after written notification of cancellation is received from the shipper. 

By signing this agreement. Shipper (or their duly appointed representative) warrants that they have read and agree to these conditions, and agrees to be bound by them as an integral part of this agreement)
